Take These Steps If You Think A Caregiver has Committed Fraud or Theft

During the process of administering your loved one’s estate, you may uncover information that leads you to believe your loved one was the victim of fraud or theft. Unfortunately, theft by home health care providers against the elderly and disabled is all too common. When these incidents occur, it can dramatically impact the inheritance that you otherwise would have received. After discovering suspected caregiver fraud or theft against your loved one, consider taking the following actions.

7 Steps to take if you Suspect Caregiver Fraud or Theft

  • Contact an experienced attorney as soon as possible. When an estate has a claim against a caregiver for suspected fraud or theft, it is important to act quickly. There are time limitations that prevent you from filing a lawsuit after too much time has passed. Similarly, as time goes on, it may become increasingly difficult to prove your claim.
  • Speak with the agency that employed the home health care provider. Report the suspected abuse and give the agency an opportunity to investigate and correct the wrongdoing.
  • File a complaint with the agency against the caregiver.
  • File the necessary paperwork to initiate an investigation of the caregiver.
  • Determine whether the home health agency had a bond on their workers to protect against cases of theft.
  • Contact the police regarding the suspected theft or fraud.
  • Gather evidence that supports your claim that theft or fraud took place. This may include the use of a camera to capture the theft. Similarly, review checkbook and credit card records to look for documented fraud or theft.

While it may not be necessary to take every step mentioned, it is important to investigate further if you suspect fraud or theft. Failing to do so could cause a loss of the assets of the estate.
