Is California Probate Ever Necessary When There is Already a Trust?

There are times when an estate may need to go through probate even if there is a will or trust. This is often the result of ambiguous or incomplete estate planning, such as a will or trust that wasn’t updated to reflect changes in the life of the decedent or unclear language in the will or trust.

Usually, this problem arises from three common scenarios:

  1. Assets were never put in the trust. It is possible to create an estate plan that appoints beneficiaries for property or accounts without officially transferring property or accounts into that trust.
  2. Assets were taken out of the trust. If an asset was removed from a trust to sell it or designate a different beneficiary, it might still be in the decedent’s name and never transferred back into the trust.
  3. Accounts were changed without transferring the trust. Even with an estate plan, if an account is closed and a new one opened in the name of the decedent instead of the beneficiary, then the account will need to go into probate.

For instance, in order to refinance your mortgage, the lender tells you that the house must be in your name. So you transfer the house out of the trust. If the house is never transferred back after the refinance is complete, then the house will go into probate after you die. There are some circumstances where, at the conclusion of probate, the court will decide that the house will be returned to the trust and need to be administered by the trustee.
