Investment Management in Probate from San Diego Probate Attorneys

In the case of probate assets, investment management is a fairly uncomplicated process. In most cases, the executor or administrator of the estate will keep the assets as they are throughout the required probate period. At the end of probate, the executor or administrator distributes the assets appropriately to the beneficiaries.

A possible complication could be the executor or administrator selling an asset from the probate estate. Not all executors and administrators are granted the authority to sell real estate from a probate estate, and in many cases any such sale will need approval from California probate court.

After the sale of an asset, the California executor or administrator must take the net proceeds from the sale and deposit them in an interest-bearing savings account.

The executor or administrator of a California probate estate doesn’t really have the opportunity for sophisticated varieties of asset management; this is because the sort of asset investment options you find in trust administration are restricted by California probate law.

Selling assets can create unnecessary problems in the probate process. We suggest to our clients that they discuss the sale of any asset, particularly real estate, with their attorney first.
