Trust Litigation

Beneficiaries of a trust may be unhappy for many reasons. The trustee may be difficult to communicate with, incompetent or even a thief. In some cases the trustee may have refused to provide an accounting of what's happened to the money and property in the trust or not given the beneficiaries the inheritance to which they are entitled. In other cases a trustee may have made terrible investments with the trust funds or had the settlor of the trust write or rewrite the trust to favor them, at a beneficiary's expense.

Will Contests

All wills are supposed to go through probate and be supervised by the probate court, but not all executors and administrators play by the rules. Some try to distribute property outside of probate or start a probate and then don't do anything. Some coerced or threatened the decedent to write a will that favored them, at your expense.

If you are unhappy with a trustee, executor, or administrator, it may be possible to have them removed and ordered to pay the trust or estate whatever their mistakes have cost the beneficiaries. If elder abuse was also committed to get their position they may also have to pay attorney's fees and court costs as well be barred from inheriting from the trust or estate.
